These Terms of Service ("Terms") govern your use of this website and the photography and video services of Via Federico's Photography, operated by Joseph Federico in Yuma, Arizona ("we", "us"). By using the site or booking a session you agree to these Terms. Please also read our Privacy Policy.
1. Services
We provide portrait, couples, family, graduation, maternity, wedding, event and product photography, and videography, as described on the Services and Pricing pages. A booking is confirmed only when we acknowledge it and the deposit in section 2 is received.
2. Pricing, deposits and payment
- Prices shown are introductory and "starting at" rates. They may change for future bookings, and a confirmed booking keeps the price quoted at confirmation. We may correct pricing errors before confirming a booking.
- A 50% non-refundable deposit is required to hold your date. The remaining balance is due on the day of the session unless we agree otherwise in writing.
- Travel is included within 40 miles of Yuma, Arizona; beyond that we will provide a custom quote before booking.
- Add-ons and extra services (such as rush editing, extra revisions or raw files) are priced as listed on the Pricing page.
- Payments may be processed by third-party tools such as Setmore. We do not store card numbers on this website.
3. Rescheduling and cancellation
- Please contact us as early as possible to reschedule. Rescheduling is subject to our availability, and we may, at our discretion, apply your deposit to the new date.
- Because we reserve your date and turn away other work, the deposit is non-refundable if you cancel.
- If we must cancel or reschedule (for example due to illness, emergency or severe weather), we will offer a new date, or a full refund of all amounts paid if no suitable date can be found.
- Late arrival may shorten your session; the end time will not be extended if it affects other commitments.
4. Weather, locations and safety
Outdoor sessions depend on weather and daylight (Yuma summers are extremely hot; golden hour is recommended). We may move or shorten a session for safety. You are responsible for obtaining permission or permits for private or restricted locations, and for the conduct and safety of your party, including children and pets, during the session.
5. Delivery
Edited images are delivered through a private online gallery, normally within 1 to 2 weeks of the session. Video and rush timelines are agreed when booking. Timelines are estimates, not guarantees. We choose which images to deliver and how they are edited. Please download and back up your files promptly; galleries are not permanent storage.
6. Copyright and print release
- We own the copyright in all photographs and video we create.
- Delivered images include a personal print release: a non-exclusive license to print, share on personal social media and display the images for non-commercial personal use. Please credit @viafedericophotos when you post.
- Without our written permission you may not sell or sublicense the images, use them commercially or in contests, or alter them beyond basic cropping, color adjustments or filters. Commercial use is available by separate agreement.
7. Our use of your images (portfolio and promotion)
Unless you tell us otherwise, you grant us a non-exclusive, royalty-free right to use images and video from your session in our portfolio, website, social media, printed materials and advertising to show our work. We will not publish your full name, address or other contact details with the images without your consent. You may opt out, in whole or in part, by emailing us before your session or within 14 days after delivery, and we will honor the opt-out going forward. If a session includes minors, the parent or guardian booking the session gives this permission and may opt out in the same way.
8. Clients, minors and permissions
By booking you confirm that you are at least 18, or the parent or legal guardian of any child being photographed, and that you have authority to agree on behalf of everyone in your group. You confirm you have the right to bring any items, artwork, logos or products you ask us to photograph.
9. Complimentary first-five-sessions offer
While building our portfolio, we are offering our first five sessions at no charge. This offer: (a) is limited to five sessions in total and is available on a first-come, first-confirmed basis, subject to our scheduling; (b) covers the session itself, while travel beyond the included 40 miles, videography, add-ons and printed products are priced separately; (c) has no cash value and cannot be combined with other offers or transferred; and (d) may be changed, paused or withdrawn at any time before a booking is confirmed. By accepting a complimentary session you agree that we may use the resulting images as described in section 7, subject to your opt-out right.
10. Results and limitation of liability
Photography is creative and subjective. We will use professional care and skill but cannot guarantee particular poses, expressions, results or that every moment will be captured. We use reasonable backup practices, but in the unlikely event of equipment failure, data loss, illness or circumstances beyond our control that prevent delivery, our sole responsibility is to refund the amounts you paid for the affected service or, where possible, to re-shoot. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any loss exceeding the amount you paid us for the service in question. Nothing in these Terms limits liability that cannot be limited by law.
11. Website use
All website content, including text, design, logo and images, is owned by us or used with permission, and may not be copied, scraped or reused without written permission. Do not misuse the site, attempt to disrupt or gain unauthorized access to it, or submit unlawful or harmful content through our forms. The site is provided "as is" and may be unavailable or contain errors from time to time. Prices and availability on the site are informational until a booking is confirmed.
12. Third-party services and links
Our contact form (Google Forms), booking calendar (Setmore) and social links (Instagram, Facebook, TikTok, Beacons.ai) are operated by third parties under their own terms and privacy policies. We are not responsible for their content or practices.
13. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve the matter informally. Any dispute not resolved informally will be brought in the state or federal courts located in Yuma County, Arizona, and you consent to their jurisdiction.
14. Changes and severability
We may update these Terms; the version posted on the date of your booking applies to that booking. If any provision is found unenforceable, the rest remains in effect.
